Seeking Asylum with a Disability-Based Particular Social Group

Throughout the world, individuals living with disabilities are often discriminated against and targeted for mistreatment because of their disabilities. For individuals persecuted on account of their disability, pursuing an asylum claim in the U.S. can raise unique challenges. Defining the particular social group, establishing a nexus between the harm and the individual's disability, and demonstrating that the harm is more than just "commonplace" discrimination can present difficult issues in claims based on disability. This training seeks to educate on the evolution of disability-based asylum claims and considerations for practitioners presenting such claims.
